Terms of Service
Effective Date: September 21, 2025
Welcome to Dreday Construction Services (“Dreday,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, forms, messaging, and field services including plumbing, drain cleaning, sewer repair/replacement, waterproofing, concrete/excavation, and related work (collectively, the “Services”).
If you do not agree to these Terms, do not use the website or request Services.
1) Estimates & Pricing
- Estimates. Written or verbal estimates are based on visible/known conditions at the time. Hidden conditions (e.g., behind walls, underground, inside piping) may require additional labor, materials, and permits.
- Scope. The final scope will be documented on the work order/invoice. Any deviations will be discussed and approved before proceeding when feasible.
- Trip/Diagnostic Fees. A service, diagnostic, or camera fee may apply and is non-refundable once performed.
- Taxes & Disposal. Prices exclude applicable taxes, dump fees, or permit costs unless expressly stated.
2) Scheduling, Site Conditions & Access
- Windows. We provide arrival windows and do our best to be on time; weather, emergencies, or permit activity may cause delays.
- Access. You are responsible for accessible work areas (clear paths, parking, pets secured). If access is not available, wait or return fees may apply.
- Utilities. You authorize us to turn water/gas/electric off/on as required. We are not responsible for pre-existing defects or code violations discovered during work.
3) Payment & Invoices
- Due at completion. Unless otherwise agreed in writing, payment is due upon substantial completion of each visit.
- Deposits. Larger projects may require a deposit and progress payments.
- Methods. We accept major cards and bank payments; financing may be available for larger jobs.
- Late balances. Past due amounts may accrue a late fee and reasonable collection costs, including attorney’s fees as allowed by law.
4) Changes, Unforeseen Conditions & Cancellations
- Change orders. If unforeseen conditions arise (e.g., collapsed lines, hazardous materials, structural issues), we will discuss options and price changes before proceeding when feasible.
- Cancellations. Please provide notice at least 24 hours before your appointment. Same-day cancellations/no-access may incur a fee.
5) Workmanship Warranty
We stand behind our work. Labor on new installations is warrantied for a period communicated on your invoice (typical range 1–12 months depending on the task). Manufacturer warranties apply to materials and equipment. Warranty is void if others modify our work, if abuse/misuse occurs, or if recommended maintenance is not performed (e.g., pump maintenance, filter changes). Drain cleaning warranties, if any, are limited to the cleared line and exclude root regrowth or new blockages from customer use.
6) Photos, Video & Reviews
We may capture before/after photos or video (e.g., camera footage) to document conditions and results. We will not publicly share personally identifying information (addresses, faces) without your permission. You authorize us to retain such media for internal records, training, and warranty purposes.
7) Safety, Permits & Code Compliance
- We follow applicable codes and obtain permits when required; permit fees/time are your responsibility unless otherwise stated.
- We do not handle asbestos, lead abatement, mold remediation, or other hazardous materials. If suspected, work pauses until a licensed specialist addresses it.
- You affirm you are the owner or have authority to authorize the work.
8) Calls, Texts & Email
By contacting us or submitting a form, you consent to receive calls and text messages regarding scheduling, estimates, and job updates at the number you provide. Message/data rates may apply. You may reply STOP to opt out of texts at any time.
9) Disclaimers, Limitations & Indemnity
- No guarantee of future conditions. Plumbing and waterproofing systems can fail due to age, roots, ground movement, or other causes outside our control. We do not guarantee future performance unless expressly stated in writing.
- Limited liability. To the maximum extent permitted by law, our total liability for any claim relating to the Services is limited to the amount you paid for the specific Service giving rise to the claim.
- Indirect damages. We are not liable for incidental, consequential, special, or punitive damages (e.g., lost profits, business interruption, secondary water damage) except where prohibited by law.
- Indemnity. You agree to indemnify and hold us harmless from third-party claims arising from your breach of these Terms or misuse of the Services.
10) Governing Law, Dispute Resolution
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Oakland County, Michigan. You and Dreday consent to such jurisdiction and venue.
11) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” will reflect the latest version. Material changes will be posted on this page.
